1. Acceptance of Terms

By accessing or using Simatom News, including our website, mobile applications, newsletters, RSS feeds, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please discontinue use of the Services immediately.

These Terms apply to all visitors, registered users, and anyone who accesses our content. Simatom News reserves the right to update these Terms at any time. Changes will be indicated by an updated "Last Revised" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

2. Description of Services

Simatom News is a news aggregation platform that indexes and displays publicly syndicated content from third-party news organizations via RSS feeds. Simatom News does not author, create, or editorially control the news content displayed on the platform.

In addition to content aggregation, Simatom News offers AI-powered analytical features, including the Perspective Analysis tool described in Section 7 of these Terms.

The Services are currently provided free of charge and without advertising. However, Simatom News expressly reserves the right to introduce, at any time and at its sole discretion, the following features and business models:

• Paid membership tiers or subscription plans, which may unlock premium features, an ad-free experience, enhanced personalization, or exclusive content;
• Advertising, sponsorships, or other commercial arrangements, including display advertising, native advertising, newsletter sponsorships, and affiliate marketing;
• Freemium models in which certain features remain free while others require a paid subscription;
• Additional AI-powered or algorithmic features, including expanded content analysis, personalization engines, or recommendation systems;
• Other monetization strategies that Simatom News may develop in the future.

If and when any such features are introduced, users will be notified through a prominent notice on the website and/or by email. Nothing in these Terms or the current free availability of the Services creates an obligation for Simatom News to continue providing the Services without charge or without advertising.

3. User Accounts

Some features of Simatom News may require you to create an account. You may register directly or via a supported third-party authentication provider (such as Google). When you register via a third-party service, we receive basic profile information as permitted by your settings on that service.

You are responsible for: providing accurate and complete registration information; maintaining the confidentiality of your login credentials; all activity that occurs under your account; and notifying us immediately of any unauthorized use of your account.

Simatom News reserves the right to suspend or terminate accounts that violate these Terms, at its sole discretion and without prior notice. We are not liable for any loss or damage arising from your failure to secure your account credentials or from service discontinuation, technical failures, or other causes beyond our control.

4. Permitted Use & Prohibited Conduct

Permitted Use
You may access and use our Services for personal, non-commercial informational purposes. You may share links to articles, provided proper attribution to Simatom News is given.

Prohibited Conduct
You agree not to:

• Reproduce, republish, or redistribute our content or aggregated third-party content without prior written permission;
• Use automated tools (scrapers, bots, crawlers, or similar) to extract content from the Services at scale;
• Impersonate Simatom News, its journalists, editors, or staff;
• Post false, defamatory, harassing, or misleading content;
• Use the Services to circumvent a Publisher's paywall or access controls;
• Systematically copy or reproduce previewed article content;
• Attempt to gain unauthorized access to any part of our systems or infrastructure;
• Interfere with the RSS feed indexing process or reverse-engineer the aggregation or AI analysis system;
• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.

Commercial Use
Any commercial or editorial syndication of Simatom News content requires a separate licensing agreement. Contact us at contact@simatomnews.com to inquire.

5. Intellectual Property

All content created by Simatom News, including but not limited to the website design, interface, logos, branding, original text, AI-generated analyses, and the overall look and feel of the Services, is the exclusive property of Simatom News or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

The Simatom News name, logo, and all related marks are trademarks of Simatom News. You may not use these marks without our prior written consent.

Aggregated third-party content remains the intellectual property of the respective Publishers. Simatom News does not claim ownership of any content sourced from third-party RSS feeds.

6. Content Aggregation & RSS Feeds

Simatom News is a news aggregation platform. All articles displayed on Simatom News are sourced exclusively from publicly available RSS feeds published by third-party news organizations and media outlets (each, a "Publisher"). By publishing a public RSS feed, Publishers make their content available for syndication. Simatom News accesses this content in the same manner as any RSS feed reader or aggregator. We do not claim ownership of, editorial responsibility for, or affiliation with any aggregated content. Simatom News honors all robots.txt directives and feed-level access restrictions.

7. AI-Powered Perspective Analysis

7.1 What the Perspective Feature Is

Simatom News offers an AI-powered "Perspective Analysis" feature that automatically evaluates aggregated third-party articles and generates an assessment of their editorial framing, language, and perceived political orientation on a left-to-right spectrum. The Perspective display may include a visual spectrum indicator, descriptive labels, and a narrative summary of the article's framing characteristics.

7.2 AI-Generated; Not Editorial Opinion

The Perspective Analysis is generated entirely by a third-party artificial intelligence system and represents the output of an automated language model, not the views, opinions, or editorial judgment of Simatom News or any of its staff. Simatom News does not manually review, approve, edit, or endorse any Perspective Analysis before it is displayed.

Perspective Analysis outputs are not statements of fact. They reflect an AI model's probabilistic assessment of language patterns and framing choices and should not be interpreted as a definitive or authoritative characterization of any Publisher, journalist, article, or viewpoint.

7.3 Accuracy Disclaimer

AI-generated analyses are inherently imperfect. Perspective Analysis outputs may be incomplete, inaccurate, misleading, or contextually inappropriate. Simatom News makes no representation or warranty that any Perspective Analysis is accurate, fair, complete, or free from error. Users are strongly encouraged to read the original article and form their own independent judgments.

7.4 No Defamation; Limitation of Liability for AI Outputs

Perspective Analysis outputs are generated algorithmically based on textual features of publicly available articles and are not intended to defame, disparage, or misrepresent any Publisher, journalist, or individual. To the maximum extent permitted by law, Simatom News disclaims all liability for any harm, reputational damage, or loss arising from a user's or Publisher's reliance on, or objection to, any Perspective Analysis output.

Any resemblance between a Perspective Analysis characterization and a defamatory statement is unintentional and a consequence of automated processing, not editorial malice.

7.5 Publisher Disputes & Correction Requests

Simatom News respects the rights of Publishers and recognizes that AI-generated characterizations may sometimes be inaccurate or objectionable. If you are a Publisher and believe that a Perspective Analysis of your content is materially inaccurate or harmful:

• Contact us at contact@simatomnews.com with the specific article URL and a description of your concern;
• We will review the flagged analysis and, where we determine it is materially inaccurate, remove or correct the Perspective output within a reasonable time;
• Publishers may also opt out of Perspective Analysis entirely by submitting an opt-out request to the same address; we will suppress Perspective outputs for your content within 72 hours.

Submission of a correction request does not guarantee removal or modification of the Perspective output, nor does it constitute an admission by Simatom News that any particular output is inaccurate or actionable.

7.6 Third-Party AI Provider

The Perspective Analysis feature is powered by a third-party AI service provider. In operating this feature, Simatom News transmits the text of publicly available aggregated articles to the AI provider for processing. Simatom News does not transmit any personal user data in connection with Perspective Analysis. The AI provider processes article text solely to generate analysis outputs and is contractually prohibited from using that content for model training or other purposes without authorization. The identity of the AI provider may change over time; the current provider is identified in the Privacy Policy.

7.7 Compliance with AI Disclosure Laws

Simatom News is committed to complying with applicable laws and regulations governing AI-generated content. Users acknowledge that the Perspective Analysis feature constitutes AI-generated content and consent to receive such content as part of the Services. Simatom News reserves the right to modify, suspend, or discontinue the Perspective Analysis feature at any time to ensure legal compliance or in response to changes in the regulatory landscape.

8. Preview Pane

Simatom News provides an in-app article preview pane as a reading convenience. Previews display only content made publicly available by the Publisher via their RSS feed. Simatom News does not circumvent, bypass, or cache content behind paywalls; does not modify, alter, or editorialize any previewed content; and always provides a direct link to the original Publisher's site. Simatom News is not responsible for content that changes, is updated, or is removed on the Publisher's site after indexing, and is not liable for any inaccuracies, errors, or omissions in aggregated content.

9. Publisher Rights & Opt-Out

Simatom News respects the rights of Publishers and content creators. If you are a Publisher and wish to have your content removed from Simatom News, or wish to opt out of the Perspective Analysis feature specifically, email us at contact@simatomnews.com with your publication name, domain, and the nature of your request. We will process removal or opt-out requests within 72 hours. To prevent future indexing, you may also restrict access via your robots.txt file or discontinue your public RSS feed.

10. DMCA & Copyright Infringement

Simatom News respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that content accessible through Simatom News infringes your copyright, please review our full DMCA & Copyright Policy for complete notice requirements and procedures. In summary, a valid takedown notice must include: your full legal name, telephone number, and email address; a description of the copyrighted work you claim has been infringed; the specific URL(s) on Simatom News where the allegedly infringing content appears; a good-faith belief statement; a statement under penalty of perjury that the information is accurate and you are authorized to act; and your physical or electronic signature.

We will respond to valid takedown notices within 72 hours. Repeat infringers will be removed from the platform. Counter-notices may be submitted to the same address; qualifying content will be restored within 10–14 business days unless the complainant seeks a court order.

11. No Editorial Responsibility

All news content displayed on Simatom News originates from third-party Publishers. Simatom News does not verify, fact-check, or endorse any aggregated article or its contents; is not responsible for the accuracy, completeness, legality, or appropriateness of any aggregated content; does not share the political, editorial, or commercial views expressed in any aggregated article; and is not liable for any harm arising from a user's reliance on aggregated content. This section applies equally to AI-generated Perspective Analysis outputs, which are governed additionally by Section 7.

12. Future Paid Services & Subscriptions

Simatom News may in the future offer paid membership plans, premium tiers, or subscription-based features. If and when such services are introduced, applicable fees, billing cycles, and payment terms will be disclosed clearly at the time of purchase. Subscriptions may auto-renew unless cancelled before the renewal date. Simatom News reserves the right to change pricing with reasonable prior notice to subscribers. Nothing in these Terms constitutes a commitment to offer any specific paid tier or feature.

13. Advertising & Sponsored Content

Simatom News does not currently carry advertising. However, Simatom News expressly reserves the right to introduce advertising, sponsored content, affiliate links, and other commercial arrangements at any time. Sponsored content will be clearly labeled as such. Simatom News will not allow advertisers to influence editorial aggregation decisions, content selection, or Perspective Analysis outputs. Affiliate links, if used, may result in Simatom News receiving compensation when users click or make purchases through those links.

14. Disclaimers & Limitation of Liability

THE SERVICES, INCLUDING ALL AGGREGATED CONTENT AND AI-GENERATED PERSPECTIVE ANALYSES, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

To the fullest extent permitted by law, Simatom News and its affiliates, officers, directors, employees, and contributors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Services, including any AI-generated content or analysis, even if advised of the possibility of such damages.

To the extent the Services are currently provided free of charge, Simatom News's total liability for any claim arising out of or related to the Services shall not exceed the greater of (a) the amount you paid to Simatom News in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless Simatom News and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to or through the Services.

16. Third-Party Links & Services

Our articles and pages may contain links to third-party websites. Simatom News does not endorse, control, or assume responsibility for the content, policies, or practices of any linked third-party site. The AI provider powering the Perspective Analysis feature is a third-party service; Simatom News is not responsible for the AI provider's availability, accuracy, or changes to its underlying models.

17. Modifications to the Services

Simatom News reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, including the introduction or removal of features, content sources, AI-powered tools, pricing structures, or access tiers. Simatom News shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

18. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts. Any claim must be brought within one (1) year after the cause of action arises, or such claim is permanently barred.

19. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Simatom News with respect to the Services.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Simatom News's failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

Assignment: Simatom News may assign its rights and obligations under these Terms without restriction. You may not assign your rights under these Terms without prior written consent.

21. Trade Secrets & Proprietary Technology

21.1 Proprietary Systems

The following elements of Simatom News constitute proprietary trade secrets and confidential information of Simatom News, protected under the Defend Trade Secrets Act (18 U.S.C. § 1836 et seq.), the Georgia Trade Secrets Act (O.C.G.A. § 10-1-760 et seq.), and other applicable law:

• The specific methodology, architecture, and implementation of the Perspective Analysis feature, including but not limited to the AI prompt engineering, scoring logic, framing classification system, and spectrum calibration techniques used to generate political orientation assessments;
• The algorithms, weighting systems, and data pipelines used to aggregate, rank, categorize, and surface RSS feed content on the platform;
• The source selection criteria, editorial curation logic, and feed evaluation processes used to determine which Publishers are indexed;
• Any proprietary training data, annotation guidelines, or fine-tuning methodologies developed by Simatom News in connection with AI feature development;
• Internal business processes, technical infrastructure, vendor relationships, and product roadmap information not publicly disclosed.

21.2 Prohibited Conduct

You agree not to, directly or indirectly:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, prompt structures, or methodologies of any Simatom News feature or system;
• Reproduce, replicate, or create derivative works based on the Perspective Analysis system, scoring methodology, or any other proprietary Simatom News technology;
• Access or use the Services in any manner intended to extract, infer, or reconstruct Simatom News's proprietary methods, prompt engineering, or trade secrets;
• Disclose, publish, or transfer any Simatom News trade secret or confidential information to any third party without prior written consent;
• Use any Simatom News proprietary information to build, assist in building, or advise on any competing product or service.

21.3 Competitive Use

Simatom News's trade secrets and proprietary systems may not be used, directly or indirectly, in the development, design, or operation of any competing news aggregation platform, AI-powered editorial analysis tool, or similar product or service, regardless of whether such use involves direct copying or independent derivation using information obtained from Simatom News.

21.4 Remedies

You acknowledge that any breach or threatened breach of this Section would cause irreparable harm to Simatom News for which monetary damages would be an inadequate remedy. Accordingly, Simatom News shall be entitled to seek equitable relief, including injunction and specific performance, in addition to all other remedies available at law or in equity, without the requirement of posting bond or other security. Nothing in this Section limits Simatom News's right to pursue any other available remedy, including claims for damages, disgorgement of profits, and attorney's fees under applicable trade secret law.

21.5 Reporting Misappropriation

If you become aware of any actual or suspected misappropriation of Simatom News's trade secrets or proprietary technology, please report it promptly to contact@simatomnews.com. Simatom News takes the protection of its intellectual property seriously and will pursue all available legal remedies against unauthorized use.

21.6 Whistleblower Notice

Notwithstanding the foregoing, pursuant to 18 U.S.C. § 1833(b), an individual shall not be held criminally or civilly liable under any federal or state trade secret law for the disclosure of a trade secret that: (a) is made in confidence to a federal, state, or local government official, either directly or indirectly, or to an attorney, solely for the purpose of reporting or investigating a suspected violation of law; or (b) is made in a complaint or other document filed in a lawsuit or other proceeding, if such filing is made under seal. This notice is provided solely for compliance with the DTSA and does not expand or alter any other provision of these Terms.
